Believe it or not, there are forms regarding the FMLA. Some of these forms are used for notice purposes, while others are certification forms. Also, some of these forms are used by employers to give the required notices to employees. And some of them are used by the employees to request leave under the FMLA qualifications.

FMLA Notice Forms
These forms are designed to establish a common understanding of the FMLA terms for both employers and employees. Notice forms are the forms used by employers, and there are four forms.
- FMLA Poster – General Notice: This is often provided to the employees once they are hired by the employer. It serves as written leave guidance and includes general information about the FMLA.
- Form WH-381 – Eligibility Notice: This form informs the employees about their FMLA leave eligibility.
- Form WH-381 – Rights and Responsibilities Notice: This form is delivered with the Eligibility Notice and informs the employee about the obligations and certain expectations associated with the FMLA leave request. It also includes information on what may happen if the employer does not meet these obligations.
- Form WH-382 – Designation Notice: This form informs the employees that their FMLA request has been approved. It also includes information about the amount of the leave. This form can also be used to inform the employees about additional information requests on their forms.
FMLA Certification Forms
These forms are also used by employers to request additional information to support the FMLA requests of employees. The employee does not have to stick to a certain format while providing the requested information. It can be official documentation issued by the army or the letterhead of a healthcare provider. There are five forms in total, and these are:
- Form WH-380-E – Employee’s Serious Health Condition: This form is used when the FMLA request of the employee is because of a medical condition.
- Form WH-380-F – Family Member’s Serious Health Condition: This form is basically the same as the previous one, but this time the FMLA request is due to the medical condition of a family member of the employee.
- Form WH-384 – Qualifying Exigency: This form is used when the FMLA leave request is because of the foreign deployment of the spouse, son, daughter, or parent of the employee.
- Form WH-385 – Military Caregiver Leave of a Current Servicemember: This form is used when the FMLA leave request is because the employee needs to take care of a family member who has a serious illness or injury.
- Form WH-385-V – Military Caregiver Leave of a Veteran: This form is used when the FMLA leave request is because the employee needs to take care of a family member who is a covered veteran and has a serious illness or injury.
